Odaily星球日报讯 在 OpenAI 诉讼案中，Satya Nadella 以微软 CEO 身份在美国加州奥克兰联邦法院出庭作证，案件围绕 OpenAI 非营利结构与商业化路径的法律争议持续升级。该诉讼由马斯克于 2024 年提起，他指控 Microsoft 在 OpenAI 从非营利组织向商业化转型过程中“协助并推动违反慈善信托义务”，微软自 2019 年起持续对 OpenAI 进行战略投资，并在 2023 年累计投资规模达到约 130 亿美元，使其成为 OpenAI 最重要的外部支持方之一。
庭审中，Satya Nadella 回顾了微软与 OpenAI 早期合作关系，并提及双方在 ChatGPT 发布前已建立深度技术与算力合作。Musk 则在此前证词中表示，微软 2023 年对 OpenAI 追加的 100 亿美元级投资是其决定发起诉讼的关键节点，并称该投资规模改变了 OpenAI 原有非营利导向结构。马斯克在庭审中表示：“我们担心他们正在把慈善组织转变为商业工具。”他同时质疑微软在通用人工智能（AGI）发展中的潜在主导地位，并指出其与 OpenAI 的深度绑定可能影响行业竞争格局。
